Reels and copyright
Last updated [DATE]. Stores on Dasurv post short videos and photos ("reels") to show their food and products. This page explains what they may post, and how the owner of a song, video or photo can ask us to take a reel down.
DRAFT — not yet reviewed by a lawyer. The highlighted parts are still to be filled in.
1. What stores may post
- Only videos, photos and sound the store made itself, or has written permission to use.
- No music, songs, film clips, TV, or other people's videos or photos without that permission. Music playing in the background counts too.
- Before posting, the store confirms that the reel and its sound are its own or that it has the rights. A video with music that is not the store's can be posted without sound.
- The store is responsible for what it posts. [MERCHANT AGREEMENT CLAUSE — indemnity, to be written by the lawyer]
2. Report a reel that uses your work
If a reel uses your song, video, photo or other work without your permission, email copyright@dasurv.app with:
- Your name, and the company you act for if any, with an email address and phone number we can reach.
- The work you own (for example the song title and artist, or a link to your original video).
- Which reel: the store's name and branch, and a screenshot or a description of the reel, with the date you saw it.
- A statement that you believe in good faith the use is not allowed by you, your agent or the law.
- A statement that the information is accurate and that you own the rights or are allowed to act for the owner.
- Your full name as a signature.
Customers can also report a reel in the app: open the reel, tap the flag, and choose "Music used without rights" or "Copied video".
3. What we do
- We review every complete notice and every report within 24 hours.
- If the reel uses the work without permission, we remove it. It is hidden from every customer and the store is told why.
- We keep a record of the removal, and we may share the notice with the store so it can answer.
- Stores may also delete their own reels, or turn a reel's sound off, at any time in the Dasurv Merchant app.
4. If your reel was removed
If you are the store and you believe the reel was removed by mistake (you made it, or you have permission), reply to copyright@dasurv.app with the reel's details, why you may use the work, and proof such as a licence. [COUNTER-NOTICE STEPS AND TIME LIMITS — to be written by the lawyer]
5. Repeated removals
A store with 3 reels removed within 12 months cannot post new reels for 30 days after the last removal. Its other reels stay up. Dasurv may lift this earlier, for example after a removal is found to be a mistake. Stores that keep breaking these rules may lose access to reels or to Dasurv. [TERMINATION CLAUSE — lawyer]
6. Contact
Copyright notices: copyright@dasurv.app. Other questions: [SUPPORT EMAIL / PHONE], [BUSINESS ADDRESS]. These rules follow the laws of the Philippines and the country where the store operates. [DESIGNATED AGENT / LOCAL LAW NOTES PER COUNTRY — lawyer]
